1995年3月24日，国家无线电管理委员会
第一条为加强对无线电发射设备的研制管理，根据《中华人民共和国无线电管理条例》制定本规定。
第二条凡在中华人民共和国境内研制（含试制，下同）无线电发射设备的单位必须遵守本规定。
第三条在本规定中，无线电发射设备定义为：无线电通信、导航、定位、测向、雷达、遥控、遥测、广播、电视等各种发射无线电波的设备，不包含可辐射电磁波的工业、科研、医疗设备、电气化运输系统、高压电力线及其他电器装置等。
第四条研制无线电发射设备必须符合国家有关技术标准和无线电管理有关规定。
第五条研制无线电发射设备必须按以下程序办理核准手续：
（一）研制单位必须提交研制申请表（见附件1）、研制单位主管部门批准文件、可行性报告及技术资料等相关文件。中央国家机关及其在京直属单位向国家无线电管理委员会办公室（以下简称国家无委办公室）领取和提交申请表，其他单位向所在省、自治区、直辖市无线电管理委员会办公室（以下简称省、区、市无委办公室）领取和提交申请表，经省、区、市无委办公室提出意见后转报国家无委办公室。
（二）国家无委办公室对申请表和相关文件进行审查。审查合格后，由国家无委办公室核发无线电发射设备研制核准批件（见附件2），并抄送相关省、区、市无委办公室。
第六条国家无委办公室和相关省、区、市无委办公室对批准的研制项目进行监督和检查。研制单位在规定时间内未能完成研制任务，必须向国家无委办公室提出申请办理延期手续，否则，国家无委办公室核发的研制核准批件自动失效。
第七条研制无线电发射设备时，如需进行实效发射，必须按设置无线电台有关管理规定办理临时设台手续。
第八条研制完成后，应由相关科技管理机构根据国家科学技术委员会发布的科学技术成果鉴定办法或其它有关规定组织技术鉴定，该研制设备的技术指标应符合国家无委办公室核发的无线电发射设备研制核准批件的要求，其鉴定的文件、资料应报国家无委办公室和所在省、区、市无委办公室备案。
第九条研制专供军事系统使用的无线电发射设备，按国家和中国人民解放军无线电管理委员会的有关规定办理。
第十条违反本规定研制无线电发射设备，按国家无线电管理有关规定给予处罚。
第十一条本规定由国家无线电管理委员会办公室负责解释。
第十二条本规定自发布之日起施行。

Article1
Inordertostrengthenthemanagementonthedevelopmentofradiotransmissionequipment,provisionsareestablishedinlinewith"theRadioRegulationsofthePeople'sRepublicofChina."
Article2
Anyunitwhichengagesinthedevelopment(hereinafterincludingtrialproduction)ofradiotransmissionequipmentmustfollowtheprovisions.
Article3
Intheseprovisions,aradiotransmissionequipmentisdefinedasanyequipmentwhichradiatesradiowaveforcommunication,navigation,
location,determination,directionfinding,remotecontrol,telemetry,broadcasting,TVtransmissionandradar
purposes.Itdoesnotincludeanyequipmentwhichtransmitselectromagneticwavefortheindustrial,scientificandmedicaluse,electricaltransportationsystem,highvoltagepowercarrierandotherelectricaldevices.
Article4
Thedevelopmentandmanufactureofradiotransmissionequipmentmustcomplywiththetechnicalstandardsofthestateandtheradioregulationsconcerned.
Article5
Approvalshouldbeobtainedaccordingtothefollowingprocedurebeforeradiotransmissionequipmentisdeveloped.
a).Theunitconcernedshouldsubmitrelateddocumentssuchastheapplicationform(seeannex1),approval
documentfromtheauthorityconcerned,feasibilityreportandtechnicalmaterials.centralgovernment
institutionsandtheiraffiliatedunitsinBeijingreceiveandsubmitapplicationformsfromandtotheOfficeofStateRadioRegulatoryCommission(hereinafterreferredtoasSRRCOffice).Otherunitsgetand
submitapplicationformsfromandtotheOfficeofRadioRegulatoryCommissioninvariousprovinces,utonomousregionsandmunicipalities(hereinafterreferredtoasLocalRRCOffice).TheseapplicationswillbetransferredtotheSRRCOfficewiththeopinionsoftheLocalRRCOfficeofvariousprovinces,autonomousregionsandmunicipalities.
b).TheapplicationformandotherrelateddocumentswillbereviewedbytheSRRCOffice.Forthoseunitswhicharequalified,SRRCOfficewillissuetheapproval(seeAnnex2)withcopiessenttotheLocalRRCOfficeconcerned.
Article6
SRRCOfficeandLocalRRCOfficeconcernedconductmonitoringandsupervisionovertheapprovedprojects.Ifanyunitfailstocompletethedevelopmentwithinthespecifiedperiod,itmustapplyfortheextensionof
theapprovalfromtheSRRCOffice.Otherwise,theapprovalbecomesinvalidinduetime.
Article7
Duringthedevelopmentoftheradiotransmissionequipment,theunitmustgothroughtheprocedurenecessaryforatemporarystationinaccordancewiththeprovisionsinregardofsettingupradiostationswhenactual
transmissionisrequired.
Article8
Uponthecompletionofdevelopment,appraisalshouldbeorganizedbythescientificandtechnologicaladministrativeorgansaccordingtotheAppraisalMethodontheScientificandTechnological
AchievementsissuedbytheStateCommissionofScienceandTechnology.Thetechnicalobjectives
shouldcomplywiththerequirementputforwardbySRRCOfficeonradiotransmissionequipment.AppraisaldocumentandmaterialshouldbeputonthefileofSRRCOfficeandLocalRRCOfficeconcerned.
Article9
ThedevelopmentoftheradiotransmissionequipmentformilitaryuseshouldfollowtheprovisionsofbothSRRCOfficeandtheRadioRegulatoryCommissionofthePeople'sLiberationArmyofChina.
Article10
Anyunitwhichdevelopsradiotransmissionequipmentviolatingtheseprovisionswillbepunishedaccordingtothestateradioregulation
provisions.
Article11
SRRCOfficeisresponsiblefortheinterpretationoftheseprovisions.
Article12
Theseprovisionsstarttobeimplementedformthedaytheyareissued.
